APPOINTING US

There are many compelling reasons to appoint Alexander Forbes Trustee Services as an independent trustee to your scheme. Whether this is to assist the existing trustee board to overcome a particular issue on a temporary basis, or to permanently strengthen the capabilities of the board, then the process is usually straightforward.

The Trust Deed and Rules will set out the power to remove or appoint trustees. Commonly this power lies with the Principal Employer. 

Where there are Member-Nominated Trustees or Directors, the independent trustee will generally make up one of the employer-nominated positions. 

Where there is difficulty in finding suitable Member-Nominated Trustees or Directors, or for that matter, willing employer-nominated trustees, the MNT requirement can be removed by the appointment of Alexander Forbes Trustee Services as the ‘sole independent trustee’.

Under this arrangement, the sponsoring company can still be part of the governing process, by way of participation in a consultative committee arrangement, but the decisions, and more importantly, the responsibility, fall on the trustee.
